Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of MakerMint Magic ("the Service"), operated by Digital Fabricators Studio ("we", "us", or "our"), located in Pembroke, GA, USA. By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using MakerMint Magic, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Notice. If you do not agree, you must not use the Service.

2. Description of Service

MakerMint Magic is an AI-powered toolkit that helps makers, crafters, and creative entrepreneurs generate product descriptions, logos, designs, mockups, and other creative assets. Outputs are generated by artificial intelligence models and are provided on an "as is" basis.

3. Account Registration & Security

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to misuse the Service, including but not limited to:

  • Using the Service for any unlawful purpose or in violation of applicable laws;
  • Generating illegal content, hate speech, deepfakes, malware, or content that infringes third-party rights;
  • Attempting to reverse engineer, scrape, probe, or interfere with the Service;
  • Sharing account access beyond permitted team plans or circumventing usage limits;
  • Using automated systems to access the Service in a manner that imposes an unreasonable load.

5. Intellectual Property

Digital Fabricators Studio retains all ownership and intellectual property rights in the Service, including software, documentation, branding, and generated template structures. You retain ownership of your inputs (prompts, uploaded content) and are granted a license to use the outputs subject to these Terms.

You are responsible for ensuring you have the right to use any content you upload, and for verifying the accuracy and appropriateness of AI-generated outputs before commercial use.

6. Payment, Subscriptions & Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

For payment, billing, tax, cancellation, and refund mechanics, please refer to Paddle's Buyer Terms. Subscriptions renew automatically unless canceled. You may cancel at any time through your account or Paddle's customer portal.

7. Refund Policy

We offer a 30-day money-back guarantee on Starter ($29/mo) and Pro ($79/mo) subscriptions. The one-time Founders Lifetime ($149) and Founder# Elite ($499) tiers are refundable within 14 days of purchase and are non-refundable thereafter, in line with the material and immediate value delivered (lifetime access, badge assignment, and all-future-features grants). See our full Refund Policy for details. Refunds are processed by Paddle; request one at paddle.net or by emailing support@kandscraftsnthings.com.

7a. Plans & Pricing Tiers

The Service is offered on five tiers, each of which unlocks a defined set of features described on our Pricing page:

  • Starter — $29/month recurring.
  • Pro — $79/month recurring.
  • Founders Lifetime — $149 one-time; grants Pro-tier access for the useful life of the Service.
  • White-Label Partner — $199/month recurring; see Section 15.
  • Founder# Elite — $499 one-time; grants Partner-tier access for the useful life of the Service, plus the Founder# perks described in Section 16.

"Lifetime" and "forever" mean for the useful life of MakerMint Magic as offered by Digital Fabricators Studio. If the Service is discontinued we will provide at least 90 days' notice and, where reasonably practicable, an export or successor pathway. We may add, adjust, or retire non-core features at any time; the core generator, export, and (where applicable) partner and Founder# entitlements you purchased will be honored.

8. AI-Generated Content

Outputs may be inaccurate, incomplete, or unsuitable for regulated professional advice without human review. You are solely responsible for how you use generated content. We reserve the right to remove or restrict content and suspend accounts for repeated infringement or policy violations.

9. Service Level

We do not guarantee uninterrupted, error-free, or secure operation of the Service. We may perform maintenance, updates, or modifications that affect availability.

10. Termination & Suspension

We may suspend or terminate your access for material breach of these Terms, non-payment, fraud or security risk, or repeated or serious policy violations. Upon termination, your right to use the Service ceases immediately, though you may retain previously exported outputs.

11. Limitation of Liability

To the fullest extent permitted by law, Digital Fabricators Studio shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Service. Our aggregate liability is capped at the total fees you paid in the 12 months preceding the claim.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Bryan County, Georgia.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

15. White-Label Partner Program

The White-Label Partner tier ($199/month) grants an active subscriber ("Partner") a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use the Service under Partner's own branding (custom logo, colors, and CNAME-mapped custom domain);
  • Provision client sub-accounts scoped to Partner's workspace and act as data controller in Partner's relationship with those clients;
  • Consume the Marketplace Integration API within the published rate limits;
  • Resell Partner-branded access to Partner's own end customers under Partner's own commercial terms.

Partner is solely responsible for its own customer relationships, invoicing (outside of Paddle-processed subscription fees due to us), tax collection where applicable, support to its sub-account users, and compliance with all applicable law in Partner's jurisdictions of operation. Partner shall not misrepresent the Service as its own proprietary technology or remove attribution required by law. We may audit reasonable usage to prevent abuse of sub-account, API, or white-label features.

Revenue-share program (if enabled). Where we make an optional revenue-share available to Partner, terms are set out in-app under the Partner portal and are payable in arrears via Paddle. Revenue-share amounts may change on 30 days' notice. Termination for cause, chargebacks, or fraudulent activity forfeits pending revenue-share. Cancellation of the Partner subscription immediately revokes the white-label license, custom-domain routing, and sub-account access; existing sub-account users will lose access unless Partner migrates them onto a MakerMint plan of their own.

16. Founder# Elite License

Founder# Elite ($499 one-time) is a limited numbered edition tier. Purchasers receive:

  • Lifetime access at the White-Label Partner feature level, including all future features, models, integrations, and export formats added to that tier;
  • A unique, sequentially-assigned Founder# badge and listing on the public Founder Wall;
  • VIP priority queue, VIP support, and early access to new features;
  • An invitation to the private founder community and direct roadmap input channel.

Transferability. The Founder# license (and the Founders Lifetime license in Section 7a) may be transferred once to a named successor by written request to support@kandscraftsnthings.com from the registered account. Transfer requires the successor to accept these Terms and does not entitle either party to a refund. We may refuse transfers that are part of a resale scheme, that would violate sanctions or applicable law, or that are made in bad faith. Badges are not divisible or split-transferable.

Suspension. Founder# perks (badge display, Founder Wall listing, community access) may be suspended or revoked without refund for material breach of these Terms, community guidelines violations, fraud, chargeback, or activity that would bring the founder program into disrepute. Core lifetime access under Section 7a is only revoked on final, uncured material breach.
